POOL SERVICE AGREEMENT / TERMS OF SERVICE (UPDATED October 1, 2024)
This agreement will remain in effect until canceled by either party. Out of courtesy we would like a 30-day notice, but you have the right to cancel at any time.
The purpose of this agreement is for Stars & Stripes Pool Service (SSPS) to perform either pool and/or spa maintenance as described below, to you (CUSTOMER) for a fee, to be paid as described below. Please note, this is NOT a contract.
Additional service visits may be needed and billed extra, above the normal service fees (e.g., storms, severe algae problems, and debris removal caused by another company). All services are performed as needed.
CUSTOMER is responsible for maintaining proper water levels in the pool/spa.
1. Frequency of Service: The frequency of service to be provided by SSPS will be WEEKLY unless otherwise agreed upon. We will do our best to keep your service day the same, however, SSPS reserves the right to perform its services on another day, if necessary. It’s highly recommended the CUSTOMER, if able, maintains the pool/spa on the off days. This includes emptying skimmer baskets, the pool sweep bag and netting excess debris from the pool. Failure to remove debris from the pool may result in unbalanced chemistry and increased cost.
2. Inclement Weather: In the event of rain or inclement weather on your service day, the pool/spa will be cleaned to the extent weather permits, chemicals will be added if needed, and baskets will be emptied. If service or partial services are rendered, service will not be rescheduled and you will be charged for the visit. During the fall months when foliage starts to fall, it is highly recommended the CUSTOMER helps remove excess debris prior to the service day. Failure to do so can result in unbalanced water chemistry and can cause your pool water to turn green. Excessive debris in the skimmers/pool cleaner bag will add excess strain to the pool equipment which could result in premature failure of equipment. During this time we can not guarantee a spotless pool.
3. Holidays: SSPS will be closed for Veterans Day, the day before Thanksgiving, Thanksgiving Day, the day after Thanksgiving and the week of Christmas through New Year's Day. We will ensure the chemicals are adjusted for the missed service days and CUSTOMER will be billed as normal for the missed service days. If your service day lands on any other holiday (e.g. Memorial Day, Independence Day etc) a chemical / basket service only will be performed.
4. Aggressive Pets: Any pet(s) considered aggressive, regardless of the size, will need to be contained in some way at the time of service. If pets are not contained and it is deemed unsafe to enter the property or exit the vehicle, service will be rescheduled and or skipped.
5. Chemicals: Chemicals are added each service visit as needed. Chemicals included with service are chlorine (liquid & tabs), muriatic acid and sodium bicarb. Any other chemical needed will be added to your invoice. If pool/spa goes through excessive chemicals due to a leak/old water, this could result in additional charges. Every Spring, a PoolRx 6 Month Algae Eliminating Mineral Pod will be added at the time of each spring filter cleaning. There will be an additional charge of $85 for the Blue PoolRx and $100 for the Black PoolRx. The amount of gallons your pool is will depend on the number of PoolRx’s you get. The Blue is rated up to 20,000 gallons and the Black is up to 30,000. Some pools will require multiple PoolRx’s. You can learn more about PoolRx by visiting www.poolrx.com.
6. Salt Pools: Salt pools require pool salt to be added in order for the cell to generate chlorine. Salt is not included with service, and will be added to your invoice at $16 per bag. We only sell professional grade pool salt and we ensure to test the salt level prior to adding so we know exactly how many bags to add.
7. Locked Gates: It is the CUSTOMERS responsibility to ensure SSPS has access to the pool on the service day. If a gate leading to the pool is locked, or access to the property is blocked, service will be skipped and you will be billed as normal. Please ensure all locks are off prior to us showing up, or provide us with the code/key.
8. Automatic Covers / Solar Covers: It is the responsibility of the CUSTOMER to have a pool cover pump, and to ensure the automatic pool cover is free of water and debris prior to arrival of SSPS. If an automatic cover has an excessive amount of water, SSPS will not open it to service the pool. If possible, we will test/add chemicals through the skimmer, empty baskets and you will be charged as normal. If you do not have a cover pump, SSPS can provide one for an additional fee. If using a solar cover, it needs to be removed from the pool prior to arrival of SSPS. If solar cover is not removed from the pool, a chemical/basket service will be performed only, and CUSTOMER will be charged as normal. A solar cover reel makes removal of a solar cover much easier, if you are interested in purchasing one, please contact us.
9. Filters: Filters will be cleaned by SSPS two (2) times per year, this will be done automatically and will be added to your invoice. The cost is $80 per filter plus the cost of any parts that may need to be replaced (e.g., O-Rings, grids, cartridges, air stems, etc). If not performed on a normal service day, SSPS will let the CUSTOMER know what day it will be done. Depending on water conditions, the filters may need to be cleaned more often.
10. Repairs: Repairs under $100 may be performed without prior notification. Repairs above this amount will require authorization from CUSTOMER. SSPS is not responsible for any parts/equipment not purchased through us. We carry a wide variety of Polaris pool cleaner parts on our trucks and will automatically replace any broken item at the time of service. If we do not have the part on hand, we will inform the CUSTOMER.
11. Pricing: The CUSTOMER agrees to pay SSPS the agreed upon amount listed above for the service indicated above and any additional services performed by SSPS. Repair charges will be priced per job with a min. hourly charge of $120.00 per man hour. All prices are subject to change without written notice.
12. Payment / Invoicing: Payment for services rendered is due upon the due date on the CUSTOMERS invoice. Service invoices will be generated on the final service day of the month. CUSTOMERS have 21 days from invoice date to submit payment in full. Invoices for repairs or installs will be due when the job is completed. CUSTOMERS can pay by check, cash or credit/debit card. If using a credit/debit card and would like to sign up for auto pay, the card will be charged at the end of the day your invoice is generated (no exceptions). Please contact us to set up autopay. If elected to receive an emailed bill, CUSTOMERS can pay via the link in the email. Please ensure to add kyle@ssps.us to your email address book to ensure delivery of invoices. CUSTOMERS who request a paper invoice in the mail will be charged an additional $5 per month. CUSTOMERS may also make a payment with a credit/debit card through www.ssps.us.
13. Late Payments / Fees: Any payment is considered late if not paid by the above-mentioned statements (Sec. 12). If payment is not received within 14 days of the due date on the invoice, a $20 late fee will be applied to that invoice. Any payment over 60 days late is subject to being sent to collections. CUSTOMER is responsible for ensuring checks sent by a bank's “bill pay” arrive on or before the due date. If you have not received your emailed invoice, check your spam folder and be sure to mark it as not spam to avoid any late fees.
14. Power Outage: SSPS will not be responsible for any power outage (inclement weather, downed pole, PG&E public shut off, etc) causing the pool and/or spa to turn green or collect extra debris. Additional charges may occur for turning water back to a clear state.
15. Above Ground Spas: We do offer chemical service for above ground spas, but we do not repair them. If repairs are needed, we will refer out a spa specialist. Included in the monthly price of spa service is chemical testing and rebalancing as well as (1) bottle of spa shock per month. If the bottle of shock is used up before the end of the month, you will be billed for additional an bottle(s). Any other chemicals needed will be an additional charge. A spa service is offered for $150 which includes draining the spa, cleaning the spa / filter and fresh filling. It’s recommended to drain / fresh fill spas a minimum of (2) times per year.
16. Changes to Terms of Service: It is not uncommon for our terms of service to change, however it does not happen often. You can always access the current up to date terms of service by visiting www.ssps.us, or by sending a request to kyle@ssps.us.
17. Termination: CUSTOMER has the right to cancel service at any time. SSPS reserves the right to cancel service at any time.
18. Disclaimer: SSPS will not be responsible for any damage to property due to acts of nature, fire, vandalism, misuse or abuse. SSPS is not responsible for the performance of any chemicals it does not sell. CUSTOMER should be aware of normal deterioration of equipment that occurs over time due to exposure to chemicals and sunlight. SSPS is not responsible for damage due to CUSTOMER not maintaining the correct water level. SSPS is not responsible for any damages or deterioration caused by failure of CUSTOMER to perform other services recommended by SSPS or by failure of CUSTOMER to properly maintain pool and equipment between visits. SSPS will not be responsible for pool/spa turning green should CUSTOMER not run pool equipment the recommended amount of time per day, and extra charges will be incurred to turn the water clear.
