POOL SERVICE AGREEMENT / TERMS OF SERVICE

This agreement will remain in effect until canceled by either party. We request a 30-day notice for cancellation, but you have the right to cancel at any time.

The purpose of this agreement is for Stars & Stripes Pool Service (SSPS) to perform pool and/or spa maintenance services for you (CUSTOMER) for a fee, as described below. Please note, this is NOT a contract.

​

1. Frequency of Service:
SSPS will provide weekly service unless otherwise agreed. While we strive to keep your service day consistent, SSPS reserves the right to adjust the day if necessary. It is recommended that the CUSTOMER maintain the pool/spa on off-days, including emptying skimmer baskets, the pool sweep bag, and netting excess debris. Failure to do so may lead to unbalanced chemistry and additional costs.

2. Inclement Weather:
In case of rain or inclement weather on your service day, SSPS will clean the pool/spa as much as possible, add chemicals if needed, and empty baskets. If partial service is rendered, it will not be rescheduled, and you will still be charged for the visit. We recommend that the CUSTOMER help remove excess debris during fall months, as failure to do so may result in unbalanced chemistry, which could turn the pool water green. Excessive debris may also cause premature equipment failure.

3. Holidays:
SSPS will be closed on Veterans Day, the day before Thanksgiving, Thanksgiving Day, the day after Thanksgiving, and the week of Christmas through New Year's Day. Chemicals will be adjusted for the missed service days, and the CUSTOMER will be billed as usual. For other holidays (e.g., Memorial Day, Independence Day), only chemical/basket service will be performed.

4. Aggressive Pets:
If you have pets that are aggressive or difficult to contain, please ensure they are secured during the service visit. If the pets are not contained and it is deemed unsafe to enter the property, service will be rescheduled or skipped.

5. Chemicals:
SSPS will add chemicals to the pool/spa each service visit as needed. Chemicals included with service are chlorine (liquid & tabs), muriatic acid, and sodium bicarbonate. Any other chemicals required will be billed separately. If your pool/spa uses excessive chemicals due to issues such as leaks or old water, additional charges may apply.


Every Spring, a PoolRx 6-month Algae Eliminating Mineral Pod will be added during your filter cleaning. The Blue PoolRx (up to 20,000 gallons) costs $85, and the Black PoolRx (up to 30,000 gallons) costs $100. Additional PoolRx units may be required depending on your pool's size.

6. Salt Pools:
Salt pools require pool salt for the chlorine cell to function. Salt is not included with service and will be charged at $16 per bag. SSPS uses professional-grade pool salt and ensures the correct amount is added based on your pool's salt level.

7. Locked Gates:
The CUSTOMER is responsible for ensuring that SSPS has access to the pool area. If a gate is locked or access is blocked, service will be skipped, and the CUSTOMER will be billed as usual. Please ensure locks are removed or provide the key/code.

8. Automatic Covers / Solar Covers:
For pools with automatic covers, it is the CUSTOMER's responsibility to ensure the cover is free of water and debris before SSPS arrives. If the cover has excessive water, SSPS will not open it and will perform service through the skimmer. If you don't have a cover pump, SSPS can provide one for an additional fee. For solar covers, please remove them before SSPS arrives. If not removed, only chemical/basket service will be performed, and you will be billed as normal.

9. Filters:
Filters will be cleaned by SSPS twice per year. The cost is $90 per filter, plus any necessary parts (e.g., O-rings, grids, cartridges). If additional cleaning is required due to water conditions, you will be notified. The cost will be added to your invoice.

10. Repairs:
Repairs under $100 may be performed without prior notification. Repairs above this amount require CUSTOMER authorization. SSPS is not responsible for any parts/equipment not purchased through us. We carry many Polaris pool cleaner parts on hand and will replace any broken item during service. If a part is unavailable, the CUSTOMER will be informed.

11. Pricing:
The CUSTOMER agrees to pay SSPS the agreed-upon amount for the service listed, plus any additional services performed. Repair charges will be billed at a minimum hourly rate of $120 per man-hour. All prices are subject to change without notice.

12. Payment / Invoicing:
Payment is due upon receipt of the CUSTOMER's invoice. Invoices will be generated on the last service day of each month. Payment is due within 21 days from the invoice date. Payments can be made by check, cash, or credit/debit card. For credit/debit payments, we offer an auto-pay option, which charges your card at the end of the service month.

13. Late Payments / Fees:
Late payments will incur a $20 late fee if not paid within 14 days. Payments over 60 days late may be sent to collections. The CUSTOMER is responsible for ensuring that payments made via "bill pay" arrive by the due date.

14. Power Outages:
SSPS is not responsible for any damage caused by power outages (e.g., inclement weather, PG&E public shut-offs) that affect the pool/spa. Additional charges may apply to restore the pool to a clear state.

15. Above-Ground Spas:
We offer chemical services for above-ground spas but do not provide repairs. If repairs are needed, we will refer you to a spa specialist. The monthly spa service includes chemical testing, rebalancing, and one bottle of spa shock per month. Additional bottles of shock will be billed separately. Drain / fresh fill services are available for an additional $150 per drain (it's recommended to drain / fresh fill a minimum of 2x per year).

16. Changes to Terms of Service:
Our terms of service may change from time to time. The most current terms are always available on our website at www.ssps.us or by emailing kyle@ssps.us.

17. Termination:
The CUSTOMER may cancel service at any time. SSPS also reserves the right to cancel service at any time.

18. Disclaimer:
SSPS is not responsible for damage to property caused by acts of nature, fire, vandalism, misuse, or abuse. SSPS is not liable for chemical performance if chemicals are not purchased through us. We are not responsible for equipment deterioration due to exposure to chemicals and sunlight. We are not liable for damage caused by the CUSTOMER failing to maintain proper water levels or perform recommended maintenance between visits. SSPS is also not responsible for pools/spas turning green if the CUSTOMER fails to run equipment as recommended.
